The investigation into the officer involved shooting on October 26, 2013, is complete and the State Attorney’s Office concluded that the response by Deputy Karen Boone was a justifiable use of deadly force.
Boone responded to a burglary alarm at Bent Tree Golf Course around 5:00 a.m., and encountered a suspicious vehicle. She attempted to speak with the female driver, later identified as Kimberly Tomchinsky, DOB 2/28/90, but Tomchinsky refused to open her door or window and was making unknown hand movements inside the car.
Tomchinsky started to drive away but quickly put the vehicle in reverse and traveled toward Boone. The deputy attempted to retreat and continued to order Tomchinsky to stop. As the vehicle got in close proximity of Boone she discharged her weapon and Tomchinsky drove away. When Tomchinsky was arrested a short time later she admitted the above and said she was under the influence of synthetic marijuana and other drugs.
The State Attorney’s Office issued its finding Wednesday. The Sarasota County Sheriff’s Office reviewed the incident and concluded Boone acted lawfully and within agency policies. She returned to full duty on November 5, 2013.
